These Terms of Use (“Terms”) govern your access to and use of the Hello Sunrise app, website, and related services (the “Services”).
By creating an account, accessing, or using the Services, you agree to these Terms.
If you do not agree, do not use the Services.
1. About Hello Sunrise
Hello Sunrise is a self-help and wellness platform designed to support mental well-being through guided content and user tools.

2. Important health disclaimer
Hello Sunrise is not a medical service and does not provide medical advice, diagnosis, therapy, psychiatric care, or emergency support.
The Services are for general self-help, educational, and wellness support purposes only.
You should not use Hello Sunrise as a substitute for professional medical or mental health advice, diagnosis, or treatment.
If you are in crisis, think you may harm yourself or others, or need urgent help, contact local emergency services or a qualified healthcare provider immediately.
The app may encourage users to seek professional help or show crisis resources in future versions, but this does not make the Services clinical care.
3. Eligibility
You must be at least 16 years old to use the Services.
By using the Services, you confirm that:
- you meet the minimum age requirement
- the information you provide is accurate and current
4. Accounts
To use some features, you may need to create an account using your email address and password.
You are responsible for:
- keeping your login details secure
- all activity under your account
- notifying us promptly of any unauthorized use of your account
We may suspend or terminate accounts that violate these Terms or create security or legal risk.
5. Testing and future paid services
Hello Sunrise may be offered free of charge during testing or pilot phases.
After testing, some or all features may be offered on a paid basis, including through an annual subscription.
If paid subscriptions are introduced:
- pricing and billing terms will be shown before purchase
- renewals, cancellation rights, and store billing terms may be governed by Apple App Store or Google Play rules where applicable
- additional subscription terms may be published and incorporated into these Terms
6. Coming soon features
Some features shown in the app may be marked “coming soon” and may not yet be active or available to users.
These features may be changed, delayed, removed, or introduced in a later version of the Services at our discretion.
7. Acceptable use
You agree not to:
- misuse the Services
- interfere with the operation or security of the Services
- attempt unauthorized access to accounts, systems, or data
- copy, modify, reverse engineer, or exploit the Services except as permitted by law
- use the Services in a way that is unlawful, abusive, or harmful to others
- use the Services to provide unauthorized medical, legal, or professional advice to others
8. Intellectual property
The Services, including the app, design, branding, text, graphics, software, features, and content provided by Hello Sunrise, are owned by or licensed to Hello Sunrise and are protected by intellectual property laws.
Except for the limited right to use the Services for their intended purpose, these Terms do not give you any ownership rights in the Services.
You must not copy, distribute, adapt, reproduce, publish, or exploit any part of the Services without our prior written permission, except as allowed by law.
9. Privacy
Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and manage personal information.
10. Account deletion and termination
You may request deletion of your account:
- within the app, where available
- through www.hellosunrisehealth.com
- by emailing [email protected]
We may suspend, restrict, or terminate your access to the Services if:
- you breach these Terms
- we believe your use creates risk for us, other users, or the public
- we are required to do so by law
- the Services are changed, discontinued, or shut down
11. Availability
We do not guarantee that the Services will always be available, uninterrupted, error-free, or suitable for every user or device.
Features may change from time to time. We may modify, suspend, or discontinue all or part of the Services at any time.
12. No warranties
To the maximum extent permitted by law, the Services are provided on an “as is” and “as available” basis.
We make no guarantee that:
- the Services will meet your requirements
- the Services will improve any health condition
- the Services will be uninterrupted, secure, or error-free
- any content or results will be complete, accurate, or suitable for your circumstances
Nothing in these Terms excludes rights that cannot be excluded under applicable consumer law.
13. Limitation of liability
To the maximum extent permitted by law, Hello Sunrise and its directors, officers, employees, contractors, and affiliates are not liable for any indirect, incidental, special, consequential, or punitive loss, or for loss of data, profits, goodwill, or opportunity arising from or related to your use of the Services.
To the maximum extent permitted by law, our total liability arising from or related to the Services will be limited to:
- the amount you paid us for the Services in the 12 months before the event giving rise to the claim; or
- if you used the Services free of charge, a nominal amount of AUD $100
This clause is subject to any rights or remedies that cannot be excluded under applicable law.
14. Indemnity
You agree to indemnify and hold harmless Hello Sunrise and its related parties from claims, losses, damages, liabilities, and costs arising from:
- your misuse of the Services
- your breach of these Terms
- your violation of any law or another person’s rights
15. Governing law
These Terms are governed by the laws of New South Wales, Australia.
You agree to submit to the courts of New South Wales, Australia, subject to any mandatory rights under applicable law.
16. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the Effective Date and may provide further notice where appropriate.
Your continued use of the Services after updated Terms take effect means you accept the revised Terms.
